By accessing or using the PoaG.ai website ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Site. PoaG.ai is operated by 21stCenturyEd ("we," "us," or "our").

2. Description of Service

PoaG.ai is a Specific Purpose Instruction Engine built on the Pdgogy.ai Universal Instruction Engine. The Site provides informational content and interactive tools for K-12 school district leaders, including:

• Readiness Assessment — An AI-powered assessment (hosted on Pdgogy.ai) that evaluates your district's readiness to operationalize a Portrait of a Graduate
• ROI Calculator — A tool (hosted on Pdgogy.ai) that estimates return on investment for implementing PoaG.ai by analyzing 24 spending categories
• Contact Form — A way to reach 21stCenturyEd for inquiries about implementation
• Informational Content — Descriptions of the PoaG.ai system, methodology, and research basis

3. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable federal, state, or local law
• Submit false, misleading, or fraudulent information through any form or tool
• Attempt to gain unauthorized access to any part of the Site or its systems
• Use automated tools (bots, scrapers) to access or collect data from the Site without written permission
• Interfere with or disrupt the Site's operation or the servers and networks connected to it

4. AI-Generated Content

The Readiness Assessment (hosted on Pdgogy.ai) generates reports using artificial intelligence. While we design the AI prompts to produce accurate, research-grounded analysis, AI-generated content is provided for informational purposes only and should not be treated as professional consulting advice. You should:

• Review all AI-generated reports with your leadership team before acting on recommendations
• Verify any statistics, citations, or claims independently
• Consult with qualified professionals for decisions affecting district policy, budgets, or personnel

21stCenturyEd is not liable for decisions made based on AI-generated content from the Readiness Assessment.

5. Intellectual Property

All content on the Site — including text, graphics, logos, design, and software — is the property of 21stCenturyEd or its licensors and is protected by copyright, trademark, and other intellectual property laws. The following are trademarks of 21stCenturyEd:

• DTIP (Digitally-Transformed Instructional Practice)
• (4Cs + 2Ps)
• STEMbedding (and its PoG-specific application, Competency Embedding)
• Portrait Operating System

You may not reproduce, distribute, modify, or create derivative works from Site content without prior written consent from 21stCenturyEd.

6. User-Submitted Data

By submitting data through the Readiness Assessment (hosted on Pdgogy.ai), ROI Calculator (hosted on Pdgogy.ai), or Contact form, you represent that you have the authority to share such information and that it does not include student personally identifiable information (PII) protected under FERPA. You retain ownership of the data you submit, and we use it only as described in our Privacy Policy.

7. Disclaimer of Warranties

The Site and all tools, content, and services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the fullest extent permitted by law, 21stCenturyEd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including but not limited to damages for loss of data, revenue, or goodwill, even if we have been advised of the possibility of such damages.

9. Third-Party Links and Services

The Site may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of any third-party sites. Your interactions with third-party services are governed by their own terms and policies.

10. Platform Terms

PoaG.ai is built on the Pdgogy.ai Universal Instruction Engine. If your district enters into a service agreement to implement the full Pdgogy.ai platform, that agreement will be governed by separate terms between your district and 21stCenturyEd. These website Terms of Service do not constitute a service agreement for platform implementation.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective when posted to this page with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Ohio.
